Visa Cancellation Reasons

Circumstances under which the
visa was granted no longer exist. (For example, where the
relationship breaks down for the holder of a Spouse temporary
visa).
Visa Cancellation Procedure
- Applicants are under an obligation to
notify the Department of Immigration and Citizenship (DIAC )of changed circumstances or
incorrect answers in the Application.
- DIAC investigates the alleged breach, and then issues a 'Notice of
Intention to Cancel' to the Applicant.
- Applicant must respond to the 'Notice of
Intention to Cancel', within a specified timeframe, with reasons why they believe the visa should
not be cancelled.
- DIAC makes a decision after
receiving a response from the Applicant.
- If the visa is cancelled - Applicant has
a right of review (Appeal).
- A non-citizen who is convicted of
certain offences in Australia, after investigation, may be subject to
criminal deportation.
